To evaluate the effect that hiring a foreign worker might have on the Canadian labor market, the LMIA is utilized.
It is important to keep in mind that applying for a work permit based on an LMIA can be difficult and time-consuming, taking months to complete.
LMIA-Exempt
A Labor Market Impact Assessment (LMIA) is a document that an employer in Canada may need to obtain before hiring a foreign worker.
However, there are certain situations where a foreign worker may be exempt from the LMIA process and can obtain a work permit without the need for an LMIA.
Below are situations where work permits can be LMIA exempt:
- Intra-company transferees
- Treaty traders and investors
- Spouses and common-law partners of certain workers
